By creating an account or using Akashic or other Colossal Capital Company ("CC") services (the "Services"), you agree to these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.
You agree not to use the Services for unlawful purposes, to circumvent security controls, to harass others, or to abuse the platform. We may suspend or terminate accounts that violate these Terms.
CC retains all rights to the Services, including software, designs, and content. You retain rights to content you create or upload. By uploading content, you grant CC a license to process it as needed to provide the Services.
If you participate in a beta testing program, you acknowledge that the Services may be unstable, incomplete, or subject to change. Beta access may be revoked at any time. Bug reports and feedback submitted during beta testing may be used by CC to improve the Services.
Some Services require paid subscriptions. Billing is processed via Stripe. Subscription fees are non-refundable except as required by law. We may change pricing with reasonable notice.
The Services are provided "AS IS" without warranties of any kind. We do not guarantee uninterrupted or error-free service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold CC harmless from claims arising from your use of the Services or violation of these Terms.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws.
We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance.
